TERMS & CONDITIONS
Article 1 : Purpose
LE bureau B.I. makes Services available to the tenants or employees of its Clients (companies or building owners) via a physical and/or digital presence on the Client's premises. "Services" refers to the products and services offered to Members. The Services are exclusively reserved for subscribing Members (employees of Client companies or employees of building tenants).
In order to provide the Services to Members, LE bureau B.I. acts on behalf of its suppliers and service providers, serving as a single point of contact for ordering, tracking and billing. These suppliers and service providers remain solely responsible for all services provided via lockers and without the intermediary of LE bureau B.I.'s on-site staff.
Article 2: Access - Orders
Members may access the Services and place an order for a product or service in person or online, via a web portal and mobile application.
Members may also use the lockers to place their orders. Orders must be placed directly by Members via the web portal or mobile app and must include the Member's locker PIN that was provided to the Member upon registration. Where there is no on-siteTenant Experience Manager, the Member's locker PIN will be provided to the Provider performing the Service for this exclusive purpose.
Receipt of the order is confirmed to the Member by email, once the items have been checked by theTenant Experience Manageror directly by the Provider. The Member is informed that the B.I. office becomes responsible for the items entrusted to its custody only from the date and time of receipt of the confirmation email. The confirmation email will include limitations if necessary.
Members may request to pick up their order in a locker. They will receive an email confirming the locker number, which will be accessible to the Member using their PIN code. Members are informed that the B.I. office is no longer responsible for the items as of the reception of this e-mail by the Members.
Article 3: Order confirmation
LE bureau B.I. will send by e-mail to the Member a confirmation slip containing the information of the order after verification of the availability of the ordered products, or, for services entrusted to the team on site or deposited in a locker (e.g. - cleaning and shoe repair), once the articles have been verified.
Article 4 : Order Modification
The modification of the order must intervene within two (2) hours following the confirmation of the order to be taken into account.
Article 5 : Order cancellation
All orders for products currently in stock at LE bureau B.I. can be cancelled at any time, without penalty. If the Member cancels an order for a product that LE bureau B.I. must order from a supplier or third-party service provider, and the cancellation occurs after the deadline indicated on the order form, the order shall be considered delivered and invoiced as such, subject to any applicable provisions of the Consumer Protection Act.)
If Member cancels a service (other than local personal errands) less than 12 hours prior to the scheduled performance time as indicated on the confirmation slip, the service will be considered used and billed as such. However, THE B.I. office will maintain a waiting list so that cancelled appointments can be transferred to another Member. If LE bureau B.I. confirms this transfer, and only in this case, the Member will be reimbursed for the cancelled service.
Article 6: Pricing of products and services
The prices of the products and services offered are indicated in Canadian dollars, excluding any federal or local taxes that may apply. The applicable taxes must be included in each monthly invoice. LE bureau B.I. reserves the right to modify its prices at any time but the products and services will be invoiced on the basis of the rates posted at the time the Member places the order.
Article 7 : Delivery
The selected products and services will be delivered to the Conciergerie or in the lockers within the time indicated on the order confirmation.
Article 8 : Guarantees
8.1 Legal guarantees
The B.I. office guarantees to the Member that it will provide the services using personnel with the required skills, experience and qualifications and that these services will be provided in a professional manner and in accordance with generally accepted industry standards for similar services. Members are entitled to legal warranties on products sold directly by LE bureau B.I., under locally applicable laws.
8.2 Return Policy
The Member has a period of seven (7) calendar days from the delivery of his order to return it to LE bureau B.I. in its original packaging and in perfect condition. It must be returned to the Conciergerie.
The right of return does not apply to:
- services that have already begun with the Member's consent before the end of the seven-day period (e.g. dry cleaning) ;
- food products that have already reached their expiration date or products with a very short shelf life, such as flowers;
- Incomplete, worn, damaged or soiled items upon return;
- products purchased on behalf of a Member from a third party merchant.
Article 9: Financial conditions
Members pay for their orders online or in person at the point of service. In case of modification or cancellation of an order, the refund will be made within 48 hours.
Article 10: Obligations of the office B.I.
THE B.I. office strives to ensure the availability of the Services at the times announced and at a good level of quality, whether they are carried out by THE B.I. office or a Provider.
THE B.I. office declines all responsibility :
- if the Member uses the Services incorrectly (incorrect service address, incorrect delivery method, etc.) ;
- if the Member fails to fulfill his or her obligations under this Agreement;
- in the event of Force Majeure as described in Section 14.2 below.
Article 11: Member's Obligations
The Member is responsible for the payment of all sums due under this Agreement and for the performance of all obligations arising from this Agreement. In particular, the Member must inform the B.I. office if he or she leaves the site where the Service is installed or leaves his or her employer, so that the B.I. office can close his or her account, in accordance with Article 16 below. If the Member does not provide such updated information, THE B.I. office shall have no obligation to continue to provide services to the Member until the information has been updated. The Member agrees not to solicit and/or use directly or indirectly the Providers independently and outside of this Agreement.
Article 12: Liability
12.1 Product information
The products and services offered comply with Canadian legislation. The descriptions of products and services provided to the Member are based on information provided by the Providers and suppliers of LE bureau B.I. and are not intended to be exhaustive. The photographs, graphics and text used to illustrate the products and services are for information purposes only. LE bureau B.I. shall not be held responsible and the validity of an order placed shall not be challenged in the event of an error or inaccuracy in any of the foregoing.
12.2 Force majeure
THE B.I. office shall not be liable to any Member, nor deemed to have failed or breached this Agreement, for any failure or delay in performing or enforcing any term of this Agreement when and to the extent that such failure or delay is caused by an event of force majeure. If the force majeure event delays or makes it impossible to execute the order for a period of more than thirty (30) days, the order may be cancelled and LE bureau B.I. shall refund the Member, if applicable. The refund will take the form of a credit on the Member's account.
Article 13: Intellectual Property
Any total or partial reproduction of the LE bureau B.I. website or any other promotional material is strictly forbidden. LE bureau B.I. and its logo are registered trademarks and protected by trademark law. They are the exclusive property of LE bureau B.I. and may not be reproduced by the Member.
Article 14: Use of personal information
LE bureau B.I. limits the collection of personal information of Members to what is necessary for the establishment and management of the relationship. For example, personal information may be collected when the Contract is signed, when Members order Services, when Services are billed and/or during any exchange or communication with the Member.
Personal information collected may include, but is not limited to, identifying information such as the Member's first and last name, date of birth, company, address, telephone number and email address.
Generally, personal information is collected directly from the Member. However, The B.I. Office may also collect information about the Member from outside sources with the Member's consent or, if permitted by law, without the Member's consent.
Information collected from the Member in connection with the Agreement and orders will be adequate, relevant and limited to what is necessary to process those orders.
In return, the Member undertakes to provide LE bureau B.I. with sincere, true and up-to-date information necessary for the execution or invoicing of the Services, failing which LE bureau B.I. will not be able to guarantee the proper execution of the orders and the Services.
In addition, the Member undertakes to keep his/her personal password and PIN code confidential and not to make them accessible to an unauthorized third party. The B.I. office declines all responsibility in the event of misuse of the password or PIN code, unless this misuse is the result of a fault on its part.
THE B.I. office undertakes to handle the personal information collected in such a way as to ensure appropriate security of the personal information, including protection against unauthorized or unlawful processing and against loss, destruction or damage of accidental origin, using appropriate technical or organizational means.
The B.I. Office recognizes that, except as provided below, disclosure of personal information to a third party requires the consent of the member.
Access to such information within THE B.I. office does not require the Member's consent but is limited to those employees of THE B.I. office for whom such information is necessary for the performance of their duties and tasks.
THE B.I. office may also share the Member's personal information, without the Member's consent, with agents, representatives, consultants, information processors, service providers and other parties for whom it is necessary in the course of THE B.I. office's business or to assist THE B.I. office in administering the business relationship with Members.
LE bureau B.I. may also, without the Member's consent, disclose personal data to the extent permitted or required by law.
In the event that the third party to whom THE B.I. office discloses personal information is located in a foreign country, local laws may otherwise permit access to such personal information by third parties without the Member's consent.
An entity or person that purchases all or substantially all of the assets of THE B.I. office or succeeds to the business of THE B.I. office through consolidation or merger is not considered a third party for purposes of this section and information provided under this Agreement may be disclosed to such entity or person.
THE B.I. OFFICE agrees to retain all personal information collected in a form that permits identification of the individuals concerned for no longer than is necessary for the purposes for which it was originally collected.
The Member has the right to access and rectify personal information collected by LE bureau B.I..
To exercise this right, the Member may send a request to LE bureau B.I. by e-mail (contact@theofficebi.com) or by registered mail (1 Place Ville Marie Montréal (Québec) H3B4M4), indicating his or her full name and address.
LE bureau B.I. shall provide a response to the Member within a maximum of 30 days.
Article 15: Termination
THE B.I. office may terminate this contract with immediate effect in the following cases
- termination for any reason whatsoever of the service contract with the client company
- termination of the Member's employment with the Client Company, as of the effective date of the termination
- departure of the Member from the Client's site, unless the Member's employer expressly authorizes access to the Services from another site.
Following the expiration or termination of this Agreement, the Member will no longer have access to the products and Services provided by LE bureau B.I.. Any annual fee paid by the Member shall be retained by LE bureau B.I..
THE B.I. OFFICE undertakes to honour the orders placed by the Member before the expiry or termination of this Agreement, even if the execution is to take place after the expiry or termination date.
Article 16: Modifications
The Bureau B.I. reserves the right to adapt or modify these conditions at any time and will communicate any changes to the Members. If the member wishes to consult these terms and conditions at any time, he can find them on the web portal or on the application.
Article 17: Applicable law
This Agreement shall be governed by and construed in accordance with the laws of Quebec and the laws of Canada applicable therein, without regard to conflict of laws. Any dispute arising from the Contract shall be submitted to the exclusive jurisdiction of the courts of Quebec, judicial district of Montreal.
